General Commercial and Civil Law
General commercial and civil law is the foundation of the firm’s practice and a sound knowledge in these general areas is a must for any lawyer practicing within the firm. It is on this pillar that lawyers within this firm then specialise in other practice areas. Maltese law remains founded principally in the civil law tradition founded on the precepts of Roman Law and the Napoleonic codes. However 160 years of British Rule have left their mark on the evolution of Maltese law, that has left significant influences in the commercial and corporate area, and particularly on Maltese company law, corporate governance, insolvency legislation and financial markets regulation. Malta’s entry into the European Union in May 2004 has further brought about new developments with a view to aligning its laws to the EU standard and introducing new ones in compliance with EU requirements.
All of the lawyers at Camilleri Preziosi are well-versed and in general commercial and civil law and advise clients in this area on a day to day basis, this includes general contract law and the general law of obligations that remain the fundamentals for the practice of transactional law.
The approach to our practice where our lawyers deal not only with their specialised areas of practice but also with the day to day requirements of our clients engages us constantly in advising clients on all aspects of the general commercial and civil law as well as assisting them in the negotiation of contracts from the most simple to the most complex, including transactions such as the sale and purchase of movables, immovables or businesses as going concerns, long or short term leases, or the granting of security over movable and immovable property, as well as claims in tort.
