Employment and Industrial relations
Adherence to the EU’s acquis communautaire has brought with it the requirement to bring Maltese employment law in line with EU standards. Accordingly, we have advised on the review of clients’ employment policies and the tailoring of employment practices in accordance with impact of EU legislation on employment matters.
In the context of larger transactions such as sales of businesses or group restructurings, we advise on collective redundancies and the effects of the Transfer of Business (Protection of Employment) Regulations, and assist in the assessment of the terms of engagement of clients’ key personnel and management teams.
On the dispute-related front, where negotiations with employees and/or trade unions prove unsuccessful, we represent clients in proceedings before the Industrial Tribunal in employee complaints and cases relating to claims of unfair dismissal, breach of contract, discrimination, working time and health and safety at the workplace.
