When dispute resolution is required, we ensure that it is conducted in a manner that is highly sensitive to the client’ s needs, especially when it is important to have his or her dispute determined swiftly and effectively, irrespective of its uniqueness or complexity.
The main areas of litigation appear in disputes and proceedings that occur in the fields of commercial, corporate, administrative, shipping, banking, tax, employment, competition and insurance.
Since the introduction of the Arbitration Act in 1996, we have advised and represented clients both in local and international arbitral proceedings conducted under the rules of the Arbitration Act (Cap. 387 of the Laws of Malta), the UNCITRAL, ICC or LCIA rules. We regularly advise on arbitration provisions as well as their implications and validity. Besides advising clients in arbitration proceedings, partners Henri Mizzi and Marisa Azzopardi are frequently appointed arbitrators.
We have gained considerable experience in mediation proceedings; an innovative and relatively recent form of dispute resolution whereby an independent and impartial person intervenes in a dispute which could give rise to proceedings, or, in proceedings between the parties which have already been instituted. Such intervention is made with a view to guide the parties towards a settlement.
Our banking litigation practice covers investor claims for damages, letter of credit disputes and general debt recovery proceedings. We act for one of the major banks in Malta, Bank of Valletta p.l.c and also advise a number of other banks.
This area has developed and grown considerably over the years. Henri Mizzi successfully acted as counsel in the first wrongful and fraudulent trading applications to be filed in Malta in the context of an insolvent company. We have also advised and acted both for insolvent companies and for shareholders and creditors, assisting them in proceeding with their claims for insolvency. In fact, we have acted in one of the first company recovery proceedings to be held in Malta.
Insurance and re-insurance litigation
We have advised and acted over a broad range of insurance and re-insurance claims. We have acted in litigation for and between insurers, the insured as well as for brokers and insurance agents in court and in confidential arbitration proceedings. In the context of precautionary security we have provided a unique kind of alternative security using an innovative approach that is a first of its kind in Malta. We also regularly act for insured where coverage is denied.
